Fraudulent conversion of property lawfully possessed


Embezzlement: Fraudulent conversion of another's property by someone in lawful possession of the property. Embezzlement requires the intent to defraud the owner of the property. Conversion here means that the defendant handles the property inconsistathntly with the arrangement by which he or she has possession of it. Since many businesses rely on employees to receive payments and make disbursements, embezzlement is often a crime against a business..

FACTS:
Gailon A. Joy owned Credit management Services Corp., (CMS), a debt collection agency. When CMS made a collection, it would deposit the money in Barre, Vermont. CMS also had it's own separate account. However, CMS began transferring fund from the Barre account to it's own account to cover it's expenses. CMS received a collection for Stacey Fuel and Lumber Co., but never even told Stacey the money had been collected. A year later CMS filed for Bankruptcy. The State charged Joy with the crime of embezzling the collection made for Stacey. Joy claimed he intended to repay the money.

Outcome:
The Court upheld Joy's conviction, saying an intent to repay was irrelevant.

Actually 3abn supporter, I found this picture myself months ago when I did my own research into Mr. Pickle's background. Since his picture is relevant in your opinion, let's include his website at: http://www.pickle-publishing.com/index.htm also to help people decide whether he is credible or not.

Oh that reminds me, are you planning to post a link to the court's order lifting the gag order since you proclaim this as a reference4links and information?

Wow--looks like Mr. Gailon Joy is an embezzler. Isn't that something serious? He should be in prison.

I love 3ABN and enjoy watching the TV programs.

Okay, taking a look at the case overview it appears that Gailon appropriated money belonging to one of his accounts after he collected the money. Additionally, he never told his account that the money had been collected. A year later upon filing bankruptcy (it would be interesting to know why he had to file) it was discovered - there is no evidence that he offered the information up, so one must assume that it was discovered in the reviews of his financial records in order to settle any issues to allow him bankruptcy protection. So, he never came clean and then Stacey filed suit against him.

The court had no problem deciding in the plaintiffs favor. Then when he appealed the decision he tried to say that A. the money belonged to him any way because Stacey owed him fees for his services, and B. he (Joy) intended to repay the money - it seems that this would be very difficult if he was filing bankruptcy, which usually leaves creditors holding an empty bag. So one can reasonably speculate that he did not intend to repay the money at all but would hide from his debts behind the curtain of bankruptcy.

Now, if you take this as a basis and then consider the experience of Alfke who had this same man leave him high and dry with unpaid rental bills (and has personal acquaintances who also experienced the same), as well as the repossession of a car, there is a pattern of financial mismanagement here. Now, it isn't on a grand scale compared to some stories we read in the newspapers, but none-the-less, there seems to be a pattern here that holds up under scrutiny. Throw in that the Federal Courts found that his actions fit the definition of embezzlement - which of course would be an ethical and moral crime as well as a crime against the land. After all this law has its roots in the Biblical admonition, "Thou shalt not steal."

Yes. Our Creator said "thou shalt not steal"

You must have some legal expertise. All I know is Mr Joy according to the law was entitled to 40%, took 100%, and now claims what he took was only what was owed to him.

If it was owed to him, why did he appeal his guilty verdict saying he intended to pay it back?

And as you said, how can you file bankrupcy and then claim You intended to pay the money back?

Our Creator also said " Thou shalt not bear false witness"

To PB, You mention that Mr. Joy appealed. What you did not mention that he lost that appeal several times. Evidently the courts disagree with your opinion.

Answer:
No.

Reason: There was no gag order.

Motions were filed asking that all be impounded, and they were impoinded temporarily until the question was resolved. That was refused.

That means each issue will now be considered individually, and ruled on by the Judge as it comes up.

This case will have many pages of arguments, and they will not all be published here.

Motions are not judgments.

Those interested in reading arguments will have to go to the court records. Including all is beyond the scope of this blog.

I will however add a link to the court case in this blog as a reference, so those interested can read all.

Are you maintaining that issues regarding Tommy Shelton are not a subject covered in your blog or one of the issues covered in the complaint against Joy and Pickle?

Are you going to moderate and remove those comments you disagree with but allow your friends whose voices are so recognizable from other forums post what they want if it supports your personal view of the issues?

The lawsuit seems to be progressing well from what is read here. Looks like 3ABN is well on their way to winning it.

I believe 3ABN is God's gift to show us the truths of the Bible.
